Searches

When you purchase a property, we will obtain a number of searches on your behalf in an effort to thoroughly investigate the property and any rights and restrictions affecting it. The most common searches and their estimated costs are explained below.

Local Authority Search

This search provides information relating to the property you are buying but does not include proposals for development of adjoining properties or surrounding areas. It includes planning history, building control history, enforcement actions, nearby road schemes, rights of way, tree preservation orders, radon gas information, village green and other designations and CIL information. These searches are usually ‘official searches’ carried out by an officer of the local authority in which your property is situate. Whilst you can understand this search yourself by contacting your local authority planning department, please bear in mind that you will still be required to pay a fee and you will need to provide us with a copy as soon as possible, Our search provider usually charges in the region of £100 - £150 for this type of search.

Environmental Search

This contains information and risks relating to environmental factors including flooding, landslides, landfill, contamination, waste sites, historical land use and other hazardous substances (normally within a range of around 500m). Please note that in accordance with paragraph 26.3 of our Terms of Business we cannot advise on contamination issues. Our search provider usually charges in the region of £40 - £100 for this type of search.

Drainage and Water Search

This contains details of the public sewer system and whether there are any sewers within the boundary of the property. It also shows whether the property is connected to mains sewage and water, has a metered water supply, whether the sewers are adopted (i.e. maintained by the local authority) and the location of public water mains which could be very important if you are planning on carrying out redevelopment work. Our search provider charges in the region of £70 - £80 for this type of search.

Bankruptcy Search /Winding Up Search

Before we complete your purchase, if you are obtaining mortgage finance, we will need to perform a bankruptcy search against each individual borrower (or a winding up search against any company purchaser). Bankruptcy searches cost approximately £2 each and a winding up search is in the region of £17 - £20.

Highways Search

This search shows whether the roads around your property are private or adopted, whether any rights of way affect your property and if there are any planned highways works in the vicinity of your property. Our search provider charges in the region of £220-£450.00.

Official Search

Just prior to completion, we will also perform an Official Search in your name(s) (or in the name of your Lender if you are purchasing with mortgage finance). This will tell us whether any additional entries have been entered on the property register since the time we obtained office copy entries and will protect you from anybody else attempting to register an entry against the title to your property from the date of your search for a period of 30 days. The cost of an official search is £3.

Other Searches

Depending on the location of your property, there are a number of other searches which we can obtain and which will provide additional information about your property and the surrounding area including chancel repair, utility searches, flood searches, hazard surveys, mining and planning searches. Land Charges searches will also be necessary when a property is unregistered. If it looks like you may benefit form additional searches, we will discuss the options and costs with you prior to obtaining these.

Land Registry Fee

Once your purchase has completed, we will register your ownership by submitting an application to Land Registry to add your names (and the details of any legal charges) to the register. The fee Land Registry charge is based upon the value of your property and an estimate will be provided as part of our online costs calculation and will be included in our engagement letter.

Identity Checks

As set out in paragraph 9.1 of our Terms of Business, we are required to verify the identity of each client. If you are purchasing your property in joint names, each buyer will be subject to separate AML (‘Anti Money Laundering’ online verification). Similarly, if you are purchasing your property as a private limited company (‘Ltd), limited liability partnership (‘LLP’) or public limited company (‘Plc’), we will need to carry out electronic identity checks on the entity as well as two members/directors as appropriate. AML checks are £6.00 plus VAT each.

Taxation

Save in relation to the information set out below, as set out in our Terms of Business at paragraph 26.1, we are unable to advise you on tax advice in connection with the sale of your property. Should you require guidance on tax issues arising our of your transaction, please consult a professional accountant or advisor.

Stamp Duty Land Tax

When a chargeable transfer occurs, Stamp Duty Land Tax (‘SDLT’) is payable by the purchaser(s) on the consideration (i.e. the purchase price). In order to complete the required SDLT Return form and pay the SDLT due on or immediately following the day of completion, we will need the national insurance number and date of birth of one purchaser who will act as the ‘lead purchaser’ for the purposes of SDLT. Before the Return form is submitted, we will ask you to check the details as payment of SDLT remains your responsibility. HMRC have imposed a deadline for submission of SDLT returns and tax (currently 30 days but is due to decrease to 14 days in April 2019) after which fines will be imposed and so it is vital that we have the necessary information from you as soon as possible. Please note that if we cannot submit the SDLT return because you have not provided us with information we have requested, we will not be responsible for paying any fines imposed.

In some cases, SDLT is not payable or the rates are reduced (certain geographical locations, first time buyers with residential properties worth less than £500,000, multiple property purchases) – we will advise you of this during the course of the conveyancing process. Where you already own a property and your purchase is an additional property, the surcharged rates will apply. SDLT rules for mixed use and/or commercial property purchases are more complex and so please contact us for more information.
Even if SDLT is not payable, in most instances an SDLT Return (‘nil return’) will still need to be filed. Examples of where returns are not needed include purchases where no monies are paid, gifts in Wills/intestacy, re-mortgages, and matrimonial (divorce) related transactions but please contact us if you are uncertain as to whether SDLT applies or not.

Timescales

The timescales are subject to change in any transaction depending on when your offer is accepted. The factors involved include:
• Number of parties in the chain• Whether you have a mortgage in place• Whether you are buying a new build property• Whether you need a lease extension for a leasehold property
A typical transaction can take between 10-14 weeks. However, if any of the above apply, or there are other factors we need to take into consideration, it may increase the time by a further 4-6 weeks and additional charges may occur. We will discuss this with you at the earliest opportunity so you always have a clear picture of how long things are likely to take.

Key Milestones

There are key milestones in every transaction which may vary according to individual circumstances. These may include:
• Taking your instructions and give initial advice based on the information you have provided
• Checking finances are in place to fund the purchase and contacting the lender’s solicitors if needed
• Receiving and advising on contract documents
• Undertaking searches
• Obtaining further planning documentation if required
• Making any necessary enquiries of the seller’s solicitor

Our pricing for bringing and defending claims for unfair or wrongful dismissal.  Simple case: £3,000.00 – £5000.00 (plus VAT)  Medium complexity case: £5,000.00 – £10,000.00 (plus VAT)  High complexity case: £10,000.00 – £20,000.00 (plus VAT)
The factors below that could make the case more complex:1. If it is necessary to make or defend applications to amend claims or to provide further information about an existing claim;2. Defending claims brought by litigants in person;3. Making or defending a costs application;4. Complex preliminary issues such as whether the claimant is disabled The number of witnesses and documents;5. If it is an automatic unfair dismissal claim e.g. if you are disabled after blowing the whistle on your employer;6. Allegations of discrimination / harassment / victimisation which are linked to the dismissal.
In a simple unfair dismissal claim there is not usually a preliminary hearing. We charge from £500 – £1,500.00 plus vat for attending a preliminary hearing, depending on travelling time and the complexity of the case. The stages set out above are an indication and if some of the stages above are not required, the fee will be reduced. You may wish to handle the claim yourself and only have our advice in relation to some of the stages. This can also be arranged on your individual needs.
Disbursements are costs related to your matter that are payable to third parties, such as Court fees. We handle the payment of the disbursements on your behalf to ensure a smoother process. If your case is complex, we may instruct a barrister. Counsel’s fees range in cost depending on their experience. Counsel’s fees can range from between £1200 – £5000 plus vat per day.
The time it takes from taking your instructions to the final resolution of your matter depends largely on the stage at which your case is resolved. If a settlement is reached during pre-claim conciliation, your case is likely to take 2 – 4 weeks.
If your claim proceeds to a Final Hearing, your case is likely to take 20 – 52 weeks. This is just an estimate and we will of course be able to give you a more accurate timescale once we have more information and as the matter progresses.

Immigration Law fees 

Immigration Applications for Leave to Remain, EU Settlement Scheme, Human Rights Applications, Indefinite Leave to Remain etc will range from £850 to £1200 plus Vat.
VAT is charged at the prevailing rate and is payable on our fees and on most expenses which we are likely to incur on your behalf. There may be some situations in which VAT is not payable. We can provide guidance on this, although you can seek your own advice.

What is included in the prices in the guide

These fees represent our professional fees; in other words, this is the amount that we will charge for the legal work that our firm will undertake on your case.
Due to the individual nature of each application, the services provided to each client may differ. Generally, in each standard application, our services will involve advising you about the relevant law and procedures, preparing the application for submission, liaising with you and third parties (where necessary) on your behalf and generally dealing with the matter until a decision is reached on the application.

What is not included

Any costs which we may incur on your behalf are not included in our professional fees. These can include, but are not limited to the following:
• Payments made to the Home Office on your behalf, such as application fees, Immigration Health Surcharge, submission costs etc.;• Payments made to the UKVI on your behalf, such as application fees, Immigration Health Surcharge, submission costs etc.;• Payments made to third parties on your behalf, such as HM Revenue & Customs, HM Passport Office or to the Land Registry etc.;• Counsel's fees. In the event of us seeking the advice of a Barrister (Counsel) you will be liable for their fees which vary depending on seniority. We will discuss with you options and costs in relation to Counsel before instructing them on your behalf and we shall keep you informed as to the hourly rate of any barristers that are instructed in your matter;• Preparing Schedules of Absences from the UK;• Fees payable to Courts or Tribunals;• External Translation fees;• Costs of Experts or Agents instructed on your behalf• Non routine postage charges and courier charges;• Travel and meeting expenses.
We also charge for other services that we can provide on your behalf. This may include:

As your matter progresses, should it become clear that further costs may be necessary, we will of course provide an update at the earliest opportunity. The fees quoted below are for standard applications, except where specified. More complex matters will attract higher fees, but we will always advise you on this.

Estimates and Quotations 

We do offer fixed fees for the most of the work that we provide and these are indicated in the guide below. A fixed fee is an agreed fee, which will not be varied up or down. As set out above, any disbursements or expenses (costs that we incur on your behalf or for the purposes of carrying out our work) are payable in addition to our fees. In the event of your instructions being withdrawn prior to the submission of the application, the fixed fee, together with any disbursements and expenses, will remain payable in full.
We also work on hourly rates. Please refer to our hourly rates.

Factors which could increase the overall cost of your case 

• Unexpected circumstances in your immigration history, personal circumstances, or financial status which we were not aware of at the outset;
• Delays in obtaining information requested;
• Information provided being inaccurate, out of date, inadequate or requiring translation; or
• Where there are short deadlines.

More complex applications may attract higher fees, and we will always advise you on this.

Factors which could decrease the overall cost of your case

This applies where a fixed fee is quoted or where the amount charged is based on the hourly rates of the people doing the work. Some examples are:
• Where we have undertaken work on your behalf in the past and your immigration history is familiar to us; or
• Where we do multiple applications for the same organisation or family; or
• Where you are able to provide sufficient evidence at our first meeting and clearly meet the applicable Immigration Rules.

Estimating the time your application will take

We will always provide you with our estimate of how long it will take to prepare your application for submission. This will be dependent on various factors, such as complexity of the matter, number of applicants/dependants or evidence required. Generally, a typical application will be prepared within 1 – 3 weeks of receiving the information required. Of course, this can vary, however should we foresee that the process will take longer than initially anticipated, we will keep you updated at all times. Please note that we will also advise on the Home Office processing times, however this will depend on the application submitted and method of submission.

Disbursements

In addition to the above, you may have to pay Home Office fees for your application and an Immigration Health Surcharge, if applicable. You may also have a biometric enrolment fee.
Fees vary widely for leave to remain or enter applications. They range between £1,033.00 (for a standard leave to remain application) to £2,389.00 (settlement) and too numerous to set out here. We can advise, upon application, of which fee applies. You may also find the full list of fees here.

Other Disbursements

Below are also some disbursements you might have within an immigration case. These depend on wht type of application you make and whether the disbursement is needed to support it. For example:
● Psychiatric / Psychology reports: £1,000.00 to £2,500.00 upwards.● Translations: £40.00 to £60.00 per page of document upwards.
The above disbursements may also be required for an appeal hearing.

Appeal Hearings

● Counsel’s fees vary upon the experience and seniority of the individual chosen; we will discuss the choice of counsel with you but in general the fees charged for an average case Counsel range from £600.00 to £1,500.00 per hearing. This fee will enable Counsel to draft an appeal skeleton argument and to represent you at your hearing.● If the Tribunal seeks a telephone Case Management Hearing, the fee is ranged around £350.00 to £650.00.● In person Case Management Hearings are normally around £450.00.

Other

●  Counsel Opinion: Counsel fees: £500.00 to £1,200.00 upwards (to give an opinion or draft grounds to lodge an appeal).● The Tribunal fees if you are appealing to the First-Tier Tribunal: £140.00 per person.● We will confirm all fees within your application including disbursements payable in advance with you.

Criminal Law

We have a legal aid contract with the Legal Aid Agency, which means that if you are on a low income, then public funding may be available to pay for us to represent you in certain criminal proceedings. As a starting point in criminal proceedings, we will ensure that we seek to apply for funding on your behalf. If you are granted Legal Aid it would cover the cost of representing you.  If you do not qualify for legal aid we can offer a fixed fee and the cost will depend on the complexity of your matter. Advise and Representation at Trial £1500 plus vat. Additional costs may be incurred if Expert witness is required to provide a report. Should this be the case we will inform you.
If a barrister is instructed to conduct your trial, those fees will be included our quoted fees.
The times scales involved will depend on the court’s ability to list the case.
A guilty plea will normally be dealt with on the day that the plea is entered unless the court requires a report from the probation service which can take up to 4 weeks.
A not guilty plea will be set down for trial and this can take up to 3 months after the plea has been entered.
There will be occasions where the court is unable to accommodate a hearing and the hearing will be adjourned to another date. This will increase the timescales involved.
