How do I know whether my dismissal was unfair?

An employer can dismiss an employee fairly for five reasons:

How do I make a claim?

If you believe your dismissal is unfair, immediately appeal it with your employer and seek legal advice.
You must also contact Acas within three months, less one day, of your dismissal, or you will be unable to lodge a tribunal claim. Acas will conduct early conciliation, providing an opportunity to reach an agreement with your employer outside of a tribunal. Your solicitor can represent you throughout early conciliation.

If Acas cannot resolve the issue, you can make a claim to an employment tribunal.

Am I entitled to make a claim?

You will usually be entitled to make a tribunal claim if:

● you are an employee (not a worker or self-employed)● you have worked for your employer for at least two years

 Automatically unfair reasons for dismissal, such as pregnancy, entitle you to make a claim however long you have worked for your employer.
