How do I know whether my dismissal was unfair?

An employer can dismiss an employee fairly for five reasons:

● performance or capability● misconduct● redundancy● breach of statutory restriction● some other substantial reason (such as the end of a fixed-term contract)

Each ground has procedural requirements that employers must follow. If procedures are not followed correctly, a dismissal will be considered unfair, even if it is for a fair reason.

If your dismissal is not justified by one of the above reasons, or you do not believe your employer followed reasonable procedures in dismissing you, you could have a claim for unfair dismissal.
