British Citizenship Solicitors, Essex

There are various ways that it is possible to gain British Citizenship, depending on your personal circumstances.

If you are eligible under more than one route then you can choose which way to apply. We can guide you through this process each step of the way.

How can you acquire British Citizenship?

If you are married to a British citizen or in a civil partnership then you can apply for British Citizenship, provided you have lived in the UK for the last three years. You must have indefinite leave to remain or settled status under the EU Settlement Scheme or have a permanent residence status (this last option is not possible after 31 December 2020).
To apply for British Citizenship, you must meet certain key requirements, including:

● lawful residence in the UK for five years● possessed indefinite leave to remain for at least 12 months● have not been absent from the UK for more than 450 days in the last five years leading up to the application and not more than 90 days in the last 12 months● passed the Life in the UK test

The process of gaining British Citizenship

The application process takes about six months, but you can remain in the UK while the decision is made and your indefinite leave to remain status is unchanged. If successful, you will be invited to a Citizenship ceremony where you officially become a British Citizen and can then apply for a British passport.

Settled status

It is possible to gain citizenship if you have settled status under the EU Settlement Scheme once you have lived in the UK for five years. You must have lived in the UK for 12 months after getting settled status.

As of 1 January 2021, those with settled status must apply for citizenship on that basis and cannot apply using the permanent residence basis. If you had permanent residence before getting settled status then from 1 January 2021 you can count that time towards the 12 months qualifying period.

Permanent residence status

You can only apply for citizenship with permanent residence if you already have a permanent residence document and did not also have settled status as of 1 January 2021. It's important to note that EU, EEA and Swizz citizens will need to apply for permission to continue living in the UK after 30 June 2021.
